All descriptions, specifications, weights and dimensions and capacities given about the goods are approximate only and are intended only to present a general idea of the goods to which they refer and shall not form part of the contract. If in any doubt as to the appearance or constitution of any product, you should contact us. Product images shall not form part of the description of any product, or part of the contract of any purchase.

6. Making a Purchase and Availability
6.1. By placing an order, you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
6.2. Making an online purchase at Kiwi Burst Interiors is easy, quick and secure and is available 24 hours a day, 7 days per week. Simply browse our online shop and add any items you wish to purchase to your shopping bag after confirming the quantity.
When you have finished your shopping, just click on “checkout” and fill out the few details needed to complete your order.
Please ensure that all fields marked with an asterisk * are completed, otherwise you will be unable to complete the checkout.
6.3. All orders are subject to acceptance and availability. If the Goods you would like to order are not available from stock, it will not let you purchase them upon checkout as it will show clearly that the item is sold out. No items will go on back order and we can contact you by e-mail or phone to let you know when the product is back in stock.
6.4. Please note that we will not be able to meet any obligations as a result of the following reasons:
6.4.1.1. If the product you ordered is out of stock.
6.4.1.2. We are unable to authorise your payment.
6.4.1.3. If it is identified that there is a product description or pricing error.
6.4.1.4. If customers do not reach any order criteria outlined in the Terms & Conditions.
6.4.1.5. If deliveries are temporarily unable to deliver due to exceptional conditions that are beyond our control including hazardous weather and accidents.
6.5. Should there be an issue with your order, we will contact you by email. If we have issues authorising payment, we will contact you via email and you will have 48 hours to respond. Failure to do so will result in your order being cancelled.
6.6. When placing an order, unless you check out as a guest, you will be added to our email list. However, should you wish to not receive mailings, please inform us and we will remove you from our emailing list. Alternatively, you can remove yourself from the Email list by amending your email preferences via the link at the bottom of each email.
6.7. Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. All prices advertised are subject to change.
6.8. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the ‘Total Cost’.
6.9. Promotions:
6.9.1. Please note that promotional codes are valid for in-stock items only.
6.9.2. Only one promotional offer can be used at any one time and any Promotion Codes are not valid during Sale Periods or on items in our Sale Room.
6.9.3. All promotional codes remain the property of Kiwi Burst Interiors and we reserve the right to stop or remove a promotion at any time without prior warning.

7. Acknowledgement and acceptance of your order
You will need to provide us with your e-mail address and we will notify you by e-mail as soon as possible to confirm receipt of your order. An acceptance of your order will take place on despatch of the good(s) ordered.

8. Ordering errors
You are able to correct errors on your order up to the point on which you click on “submit” during the ordering process.

9. Our Contract
We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.

10. Website Product Pricing & Descriptions
10.1. We undertake all reasonable care to ensure that all the details, prices and descriptions of products on our website are accurate at the time when they are entered onto our system. Whilst we always endeavour to keep the website as accurate and up to date as possible, there may be rare occasions when the information on the website at a given time may not precisely reflect the position exactly at the point an order is placed. We do not give any warranty as to the accuracy or completeness of the information and cannot be responsible for any errors or omissions or for the results arising from the use of such information.
10.2. Please note that we are unable to confirm the price of a product until your order is accepted in line with our order acceptance conditions. We take every care to ensure that the description and specification of our products are correct at the time of going to press. However, specifications and descriptions of products on this website are solely to provide an approximate idea of the goods they describe and do not form part of the contract between you and us and are not intended to be binding.
10.3. The prices payable for goods that you order are as set out in our website are in £s sterling. All prices are inclusive of VAT at the current rates and are correct at the time of entering information. Prices exclude delivery.
10.4. Wherever it is not possible to accept your order to buy goods of the specification and description at the price indicated, we will advise you by email, offer to sell you the goods of the specification and description at the price stated in the email and will state the period for which the offer or the price remains valid.

11. Payment terms
11.1. Payment can be made by via PayPal with Master card, Visa, Debit Cards, Connect and Switch. We do not accept American Express. Payment will be debited from your account before the dispatch of your purchase.
11.2. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Site.
11.3. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the goods from your account, then we can cancel the contract and or suspend any further deliveries to you. This does not affect any other rights we may have.

12. Faulty Goods
We truly hope you will be delighted with your order; however, the goods are faulty if they are received damaged. Any damages, breakages or missing items must be reported to us either by email or by telephone call within 7 days.

13. Delivery charges
13.1. Delivery charges vary according to the type of goods ordered and cannot be refunded. They are set out clearly under the “Shipping” section on our website.
13.2. We will deliver the goods to the address you specify for delivery in your order. It is important that this address is accurate. We cannot accept any liability for any loss or damage to the goods once they have been delivered. Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which we will not be responsible
13.3. You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
13.4. International delivery is not available.

14. Cancellation rights
14.1. We hope that you will be delighted with your order, however there may be an occasion where you need an exchange or a refund.
14.2. If you are a UK consumer, you have the legal right, under the Consumer Protection (Distance Selling) Regulations 2000 to cancel your order within fourteen days following your receipt of the goods or the date on which we begin provision of the services.
14.3. Damaged or incorrectly supplied products: You should check all products you receive against your order. If the products you receive are damaged or incorrectly supplied on delivery then you must note the details of any damage or error in supply and inform us (by phone or e-mail only) within seven days of delivery. You must return the products to us as soon as possible (within seven days of receipt of your order) after informing us that the products are damaged or have been incorrectly supplied. Please note that we will not accept the return of any damaged or incorrectly supplied products where you fail to notify us of this within fourteen days of receiving them.
14.4. Other cancelled products: If you want to cancel products that are not damaged or incorrectly supplied, then you must inform us of this within seven days, starting the day after you receive the order. You must take reasonable care of the products that you wish to cancel and not use them. Products should be returned at your cost within fourteen days of receipt of your order.

15. Cancellation by us
15.1. We reserve the right to cancel the contract between us if:
15.1.1. we have insufficient stock to deliver the goods you have ordered;
15.1.2. one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
15.1.3. If we do cancel your contract, we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order.

16. Liability
16.1. Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
